$750,000 Settlement for Forklift Accident

On January 14, 2021, the plaintiff Angela Massey was in the course of her employment with the United States Postal Service unloading a trailer with her forklift. While inside the trailer, the defendant, Qasim Shafiq Mujtahid (employed by defendant, DDA Transport, Inc.) began to pull the trailer away with his truck. Mr. Mujtahid did not take any steps to check that the trailer was safe to be pulled away from the docking bay or that anyone was inside. Thereafter, Ms. Massey’s forklift was caused to fall backwards out of the trailer. As a result of the incident, Ms. Massey sustained significant injuries to her lumbar spine which required hospitalization and various medical treatment. She underwent a multitude of epidural injections and two radiofrequency ablations on her lumbar spine. She was also recommended for a lumbar fusion surgery at an estimated cost of $250,000. She has been out of work since the time of the incident. Suit was filed against the defendants on November 17, 2022. The Plaintiff was represented by Robert J. Banas, Esq. of Eichen Crutchlow Zaslow, LLP. After mediation on the case was unsuccessful, the matter was conferenced by the Honorable Bruce Kaplan, who was instrumental in facilitating resolution of the case. The matter was resolved on July 23, 2024.
